LEGAL ISSUES continued from page 32 Even greater exposure occurs when estheticians or other non-medical personnel perform the medical treatments or utilize medical products or devices, as in laser hair removal or IPL photofacials. As I have said many times: There is no such license or offi cial designation as "medical esthetician." Utilization of a hair removal laser is considered the practice of medicine, because the lasers and light-based devices used to deliver treatment are federally classifi ed as medical devices. Therefore, they must be owned and operated by a physician (subject to delegation). Many "medical spas" are owned by registered nurses. In most states, registered nurses cannot own medical practices or perform medical services absent appropriate agreements with a physician. Even when there are appropriate agreements, these will not necessarily justify departure from state CPOM or UPM regulations. Physicians who supervise such scenarios need to ensure as much compliance as possible. You must clarify the arrangement through agreements with the owner of the facility and document all training, policies and procedures. There is little margin for error in this scenario since it is not legally supportable. Insurance is a concern as well, because the carrier does have a legal basis to deny coverage if a patient is injured by a non-medical provider in a non-physician-owned facility. If you are the supervising physician at a non-physician-owned facility and you have an agreement to provide supervision for its employees, your professional negligence policy will not automatically cover you. Therefore, it is prudent to gauge your comfort level with the owners and operators of the facilities and consider the possible ramifi cations of adverse events or injuries that may result from treatment prior to taking part in an off-site supervision arrangement.
